The fields include document number, first, middle, and last names, marriage date range, and recorded date range. However, a search is possible even if only the name is available.

Once the search criteria are entered, the results will list the marriage license number, searched name, name of partner, marriage date, and application date. By selecting a license number, further information about the document will be displayed, such as the type, book and page numbers, and a scanned image of the marriage record.

In person and by mail: For in-person and mail requests, the Marriage License Copy Request Form should be completed.19 In addition, if you’re requesting by mail, include the names of the parties, the date of marriage, and a return address. A self-addressed stamped envelope is encouraged to be included as well for a shorter turnaround time.

The cost is $1 for a plain copy and $6 for certified copies. Payments should be done by check, money order, or cashier’s check, not cash, and payable to Montgomery County Clerk.

Access Montgomery County Public Records Responsibly & Know Your Rights

While people generally have the right to access public records as stated in the Freedom of Information Act (FOIA) and Texas Open Records Policy, it is still important to be responsible in handling and using the information that will be gathered.

There are laws set to prevent the misuse of public information, whether for professional purposes, such as making decisions for housing, employment, and licensing, or for personal use, such as obtaining personal records or screening neighbors and potential dates.

Policies like the Fair Credit Reporting Act (FCRA) ensure the fairness, accuracy, and privacy of consumer information. Per the FCRA, applicants also have the right to be notified of any decision made based on the background check.

If this law is believed to be violated, a complaint can be filed with the Federal Trade Commission (FTC).

Furthermore, the Equal Employment Opportunity Commission (EEOC) and the Texas Workforce Commission protect potential or current employees from discrimination at work based on their background. A charge can also be filed if you feel you have been discriminated against.22
