How To Retrieve Montgomery County Marriage Records
As a citizen, you can access Montgomery County marital records through Clerk’s Public Records Portal.1 To perform a search, select “marriage license” on the left-hand side under the search types. On the right-hand side, you have the option of selecting whether you want to search for formal or informal (common-law) marriages.
After you make that selection, you can search by the document number or a person’s name. If you conduct a name-based search, you can also include a date range for when the parties were married or when it was recorded.
For all matches, the results page will provide the license number, both names on the marriage record, the date married and when the application was submitted. You can click on the license number to get additional information, including a PDF of the original marriage certificate. The search tool allows you to save and print this informational copy of the marriage certificate.
You can also request an informational or certified copy of a marriage record in person or by mail by completing the Marriage License Copy Request Form.3 The completed form can be brought in person or mailed to the address below:

How To Look Up Archived Marriage Records in Montgomery County Texas
When performing a genealogy search or dealing with a complex legal or business situation, you may need to access archived marriage records. Sometimes, these records can be held with different custodians and may be trickier to find.
To find archived Montgomery County marital records, you can inquire with the Clerk’s Office or use their Online Public Records Portal.4, 1 Archived marriage records are not held by a separate county office and should be accessed through the Harris County Clerk as the records custodian.
You may also want to look for archived marriage records with historical societies, public libraries, churches and other religious institutions. At these places, you may uncover marriage records in old newspapers, indexes and other recorded documents.

A record seeker may also want to inquire about archived marriage records with the Family History Centers through the Texas State Archives & Libraries.6
A citizen can also look up records on common-law marriages. Common law marriages are legal, and they provide a process for allowing couples to request that their relationship be recognized as legal without a license and ceremony.
How To Look Up Texas Marriage Records Outside of Montgomery County (Statewide Search)
You now have a firm understanding of how to look up and request Montgomery County marital records. You can take this information and find similar processes in other Texas counties, although each county may have unique nuances. A quicker way is to access all marriage records through a state government agency.
If you want to expand your search, you can access certain marriage records with the Texas Department of State Health Services Vital Statistics Section.7
The Vital Statistics Section specifically provides verifications of a marriage from 1966 to the present. If you need a copy of a certified marriage certificate, you will have to use the resources provided earlier to request information at the county level.
The Vital Statistics Section will only provide a verification to certain qualified individuals. Those qualified persons include the following:
- Either person listed on the marriage certificate
- Parents or guardian
- Spouse
- Children
- Siblings
- Legal representative
- Individuals with a court order or proof of tangible interest
To submit a request for marriage verification, you will need to provide your contact information, relationship to the individuals listed on the record and purpose for the request. You will also have to identify the marriage record by providing both individuals’ names, date of marriage and location.
The first option for obtaining a marriage verification is to complete the Vital Statistics Section’s Online Request Form.8 Processing time for an online submission takes approximately 20 to 25 business days. Alternatively, you can complete the Application for Marriage Record Form.9

The fee for a marriage verification is $20.00. A free option if you just need the data for informational purposes is to look up the Vital Statistics Section’s online marriage indexes starting in 1966.11 For marriages in Texas during this time, you can search by year and view the parties’ names, ages, file numbers and the date and location of their marriage.

How Do You Apply for a Marriage License in Montgomery County Texas?
If you and your partner have decided to get married, there is a process you must follow before exchanging your vows. The first step is to apply for and receive a marriage license.
In Montgomery County, you can apply for a marriage license with the County Clerk.4 The Montgomery County Clerk is located at the addresses below:

One option for applying for a license is to start the process before you go to the office by completing the Montgomery County Online Marriage Application.1 You can also complete a hard copy of the Information Sheet for Marriage License Application and bring it with you when you go to apply.12
You can also relay the information to the clerk verbally at their office, although this is the slowest process. Either form will require you to provide the name and contact information for each party, date and place of birth and social security number.
In Montgomery County, both parties must be 18 years of age or older or have received a court order for Removal of Disabilities of Minority.13 To be eligible, you also must be divorced for at least 30 days unless the requirement is waived by the judge or you are getting married to the person you just divorced.
To verify both parties’ name and age, a person must provide valid identification. Valid identification includes a passport, driver’s license and other valid U.S. government-issued photo identification.
When you go to apply for the license, both parties must be present. However, exceptions are provided for when a single applicant can go in to request a marriage license. In these situations, a person can provide a signed and notarized Affidavit of Absent Applicant.
The fee for a marriage license is $82. If both parties are out-of-state residents, the fee is increased to $100. Checks and money orders are not allowed, and the fee must be paid in cash.
Once the marriage license is issued, parties must wait at least 72 hours until they have their wedding ceremony. Exceptions are allowed if a party is on active duty in the military or if waived by a judge with jurisdiction over these matters.
There is also a time limit on when a marriage license expires. The parties have 90 days to get married from the date the marriage license was issued.
